1. Introduction
Welcome to XowiePOS. These Terms & Conditions ("Terms") govern your use of our integrated Point of Sales (POS) software, designed to manage your shop's products, sales, suppliers, and salespersons. By using XowiePOS, you agree to these Terms in full. If you disagree with any part of these Terms, you must not use XowiePOS.
2. Use of XowiePOS
2.1 Eligibility
You must be at least 18 years old to use XowiePOS. By using XowiePOS, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
2.2 Account Registration
To access certain features of XowiePOS, you must register for an account. You agree to provide accurate, complete, and updated information during the registration process. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
2.3 License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use XowiePOS for your personal and business purposes.
3. User Responsibilities
3.1 Acceptable Use
You agree to use XowiePOS only for lawful purposes and in a way that does not infringe the rights of others or restrict or inhibit their use and enjoyment of XowiePOS. Prohibited activities include, but are not limited to:
- Using XowiePOS for any unlawful purpose
- Impersonating any person or entity
- Hacking or attempting to hack into any part of XowiePOS
- Sending unsolicited advertisements or spam
3.2 Data Accuracy
You are responsible for ensuring that all information you provide to XowiePOS is accurate, complete, and up-to-date.
4. Fees and Payments
4.1 Subscription Fees
Certain features of XowiePOS may require payment of subscription fees. By selecting a subscription plan, you agree to pay the applicable fees. We reserve the right to change our fees at any time, but we will notify you in advance of any fee changes.
4.2 Payment Terms
All fees are due in advance and are non-refundable. You authorize us to charge your designated payment method for the applicable fees.
5. Intellectual Property
All intellectual property rights in XowiePOS, including but not limited to software, text, graphics, logos, and trademarks, are owned by or licensed to XowiePOS. You agree not to reproduce, distribute, modify, create derivative works of, publicly display, or publicly perform any of our intellectual property without our prior written consent.
6. Data Privacy
Your use of XowiePOS is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and disclose information about you.
7. Termination
We may terminate or suspend your access to XowiePOS immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use XowiePOS will immediately cease.
8. Limitation of Liability
To the maximum extent permitted by law, XowiePOS and its affiliates, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use XowiePOS
- Any conduct or content of any third party on XowiePOS
- Any content obtained from XowiePOS
- Unauthorized access, use, or alteration of your transmissions or content
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Ghana. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ghana.
10. Changes to Terms
We may revise these Terms from time to time. The most current version will always be posted on our website. By continuing to use XowiePOS after any changes become effective, you agree to be bound by the revised Terms.
